Hi,

I request advise on the following :
  1. It is mandatory that a Will executed by a Hindu or Christian be probated.
  2. Is it manadatory that society must ask for Probate of a Will before transferring any flat to the name of a beneficiary of will.
I am seeking answers to the above as our society has transferred many flats to the names of beneficieries based on Nominatin and a Will. But, our auditors have raised objection and have advised us to ask for probate of Will in all cases.

Can anyone please advise ?

[Hello, In Annual general meeting of the society majotiry members has passed a resolution that if you have a landlord but if you can give it on rent. You have to pay double maintainance. Instead of In Ahmedabad City Majority the above ratio are one and half. Now what can I do with elected members of the society. Pl Reply. Thanks. Rakesh

1) As per the Will you have need not to take Probate As per latest amendment but suppose any heirs creates object you have to take a probate from the court.

2) Nominees are not entitled for benfit without will, relation he is only entiled as per succession act.

Hi,

Can the Managing Committee members who have completed their term of 5 years recontest for election for the next term? Please note that a case of misappropriation of society funds, against the Office Bearers, is pending before the Jt. Registrar of Societies.

As per the bye laws - anyone stand for reelections. subj to members voting the subject candidate. as far as misappropriation is concerned its up to the members to decide.

Hello Sir,
I stay in a co-operative housing society at ahmedabad,Gujarat(India). I have purchased my home 2 years back. And has give application for transfering my home in our co-operative housing society. But society committie members asking 51,000 rs fees for transfering.So have keep this matter as it was. But now days they demand for 75,000 rs.I have also ask him for any legal documents but they people refuse to give any documents supporting that demand(Transfer Fees). And continuously demand me for same.

Can you help me in this case or guide me what i should do in this matter?

hello,

We are registred society with 10 members each alloted car parking space in the AGM.Now one member who got a new car is disputing that he wants to change his parking allotted to him and other 9 members donot agree what action can society take
